Family member that won't leave house

I will try to make a long story short. I rented a house from my mother. No formal rental agreement. My mother and I allowed my brother to move into the house in order to help out with rent. Again, no formal rental agreement.

He stopped "helping out" July 2002. I asked him to leave several times. When I couldn't get him to leave, I gave my mother notice and moved out. Now my mother wants to rent the house out, and has asked him verbally to leave. He is still there after 6 months.

Other than this being a disfuntional family situation, where does my mother stand as far as forcing him out? Can she just call the police? Does she have to give him a written notice and allow him a certain amount of time...then go through the court?

My response:

Go to Barnes & Noble bookstore. They have Landlord / Tenant books, written in easy to understand language. The books are fairly inexpensive and contain the forms of Notices and court forms that could be needed if he fails to leave on his own.

Go buy the book.
