What is the name of your state (only U.S. law)? california. a tenant's lease ends 7/18/15. can she give notice now to move at the end of the month (july rent will be paid in full) or can i ask her to wait until the end of her lease period to give 30 day notice making the move date 8/18/15 (pro rated rent will be paid for aug). thanks.

Absent language to the contrary in the lease, she can leave upon expiration of the lease.

Your Answers are 1 If your lease set a number of days notice ( or said that whole rental period of notice was required) to you before the end of it to either renew or give notice to vacate then that is what you both follow. 2 if your lease said it didn't auto renew then it would be fair to expect them to move by the end of it especially if it clearly said they were to vacate by the end of the lease . Im not sure if you just didn't think about it when you began this lease with the tenant but id suggest you consider making sure your next lease spells this out. (its a learning curve )
