As I said what the LL did was wrong. I believe she is about to reap what she has sewn! Hopefully the powers will shut her down so she won't be able to do this to anyone else.

I just don't see how her misdeeds = you getting to live for free. I get what the other one posted the law says bla, bla, bla I get it. What you are doing is what the law allows, good for you!

I myself couldn't live happily off of another no matter what wrongs they did. It's not right, pay your own way, it feels good!

Yes, you are absolutely correct, and once again I will lose sleep and have to use another sick day off from work.... till inspector comes...

I thought I made it abundantly clear that I am not happy over this situation!
I paid my own way, even electric bills that were not entirely mine, but I paid and that did not make me feel good.....(in my illegal apt the electric meter was wired for much more than my place but I paid!)

I just want you to know that in each and every state, it is illegal to kick someone out of their home, illegal or not, without a judges approval.

New Jersey is not at all better protected than any other. Worst law comprehension online too, and other then Washington where a LL can lock out a tenant if the lease permits it, NJ does not have some of the best LL tenant laws in the USA.

Just don't pay her anymore and wait to see the judge when she files against you... what are you stressing for?

Are you scared the inspectors will find it to be legal and the tables will turn on you? (you pay court costs, and back rent, and late fees, and have too move too? ) Because thats what you should be worried about.

This is not entirely true. The occupant COULD be forced out by the code inspectors, if things are bad enough.

ETA: By "code inspectors" I actually mean the city/municipality.

OK maybe I overstated that NJ has some of the best tenant laws. I was just impressed that I had some leverage in this situation.
I am stressed over this whole situation and if the code inspectors should find this apt legal I will be surprised. I owe no money for backrent, late fees or court costs or bills as I am not a deadbeat. It has been 3 days since I called code enforcement and they still have not called for appointment. I would feel better getting this over. I will update anyone who is interested.

Udate on illegal apt.


Well the city code enforcement officer was here today to look at my apartment and yes, like I suspected it is illegal. So LL will be given a summons/violation. The initial fine is $1500.
I want to thank every one for their input and help. I did alot of research as I knew nothing about illegal apts nor the law when I felt like my back was against the wall ( also alot of praying).
Once again I thank everyone who contributed to this topic. Alls well that ends well...
