    Arizona

    Is this grounds for early termination of my lease?

    What does it depend on?

    He came into my apt to clean up for a showing, he even made my bed.

    I was not given any notice reguarding his entry.

    Send your LL a letter via certified mail telling your LL that you understand he has the right to show the unit with REASONABLE notice but he does not have the right to disturb your personal property. Tell your LL you expect reasonable notice for any entry that is not a true emergency and bluff him /her tell him her you have installed a hidden camera system that will record all entry to the unit when your not in the unit. Just keep in mind one of these showings could be to the person who will be your new LL.

    Jeeze...the CLEANING FAIRY came and cleaned up your apt....You should have made your bed yourself. Make sure your landlord has your CURRENT contact information and ask for 24 hours notice of his entry next time.

    AZ law requires the landlord to give a 48 hour notice to enter.

    Grounds for termination???? Only a judge can decide that.

    No this is not the way. What does your lease state about early termination?

    Why is your landlord showing your apt if you are on a lease?

    You are leaving something out of your post!

    Forget the "hidden" camera idea. It could get you arrested if it is not legal in AZ.

    I live in a guesthouse and the property is for sale.

    Your LL MUST give you proper notice, inform LL you will call the police and report a break-in the next time it happens. If you happen to come home and they are in there, call the police and report a break-in with the suspects still in the unit.

    The LL can talk it out with the police, and yes, hidden cameras are allowed as long as you notify them...

    Hum your going to have to be able to prove repeated multiple violation over a period of time in order to be able to satisfy the court that your LL was violating law or lease by not giving notice. Your best bet is to learn if this guest house is zoned to be used as a rental and if the zoning your city/county has set for this address is only single family home use ( not zoned for multiple unit) then you would have to be prepared to move when you call the city/county zoning dept out to verfiy wether the unit meets codes to be used as rental, because if it is not then they should issue a condemn notice ( any kind of letter that says the unit can not be lived in or used as a rental ) Thats what will get you out of your lease. BTW if the property is zoned properly then of course you get to stay and still have to address the LLs lack of notice for entry as it happens.

    just for the fun of it Who's Liable, try finding such requirement for Michigan. I can find several other states that there is no statute requiring notice as well.
