Signed 1yr lease 2 1/2 mths ago. Found letter in mailbox from landlord she is filing bankruptcy, letter said to contact mortgage co. reguarding how long we have. They can't / won't give any info
2 Attys said lease will not be valid if she relinquishes property.
How long do we have to find a new home?

You stay where you are for as long you have not received a notice to vacate the apartment. The notice should specify a number of days left with the option to appear before a judge to show good cause why you should not vacate the apartment.

Do not skip paying your rent to your landlord. If landlord askes to direct the payment to a third party then ask him to give this instruction in writing. If he refuses to take the check, write a memo to him, dated and signed, reminding him that he refused to accept the check and refused to tell you to whom you should send it. Tell him that the check is available for him any time he wishes to cash it, or to transfer it to a third party. Do the same every month and keep copied of your memos.
