landlord is a scumbag


What is the name of your state? ny mass. on july 20 2004 a fire in the basement destroyed the 2 family home i rented an apartment in. per phone conversation with my landlord who lives in Boston, she told me she wasnt sending my 600.00 security deposit back and that i would have to take it up with the insurance co. fire is still under investigation. can i file in small claims court here in utica ny or do i have to go to Boston to file against her?

Apparently the cause of the fire is undetermined. IE liability issue of fire is unresolved.

You should wait to file anything until the cause of the fire is determined. Have you contacted the insurance company or are you only speaking with the landlord?

You do realize this fire was just a month ago, right?

yes i do realize the fire was only a month ago. but i also realize tenants are not covered by the homeowners insurance. i am a single ,disabled mother of 2 small children. i cant get a new place to live until i get my security back. im living place to place with friends.

**A: if you are deemed to be the cause of the fire, then you would not get your deposit back.

landlord is a scumbag


i will in no way be held accountable for the fire. just irritated that an immigrant now residing in boston who uses several alias names can purchase property in ny and be exempt from the tenants rights law. by the way.this landlord is in the high risk pool per her insurance agent.

was the unit condemned where no one can live in it by a city order ? If so contact your city to learn if there is any ordinance or your state govt web page links for LL and tenant to learn if LLs have so many days after a condemn order has been issued to return deposits . The last place I had rentals in required that deposits be returned with in 5 days of a condemn order or a penalty could be ask for ontop of the deposit in small claims court . If you cannot find a clear answer then try the links up top and arrange for a consultation with a atty .

land lord is a scum bag


no clue....but good question.last i heard, they suspected arson. landlord would make out handsomely if that were the case. btw..the land lord refuses to give the other tenants thier security as well. but will look into the condemned issue.
