landlord selling


What is the name of your state? Florida

I live in florida and after leasing off the same landlord for 8 years now I went in to inquire about my upcoming lease. I informed them I would like to renew my lease for another year. At that time the office manager said that some units were not being renewed as the buildings may be sold. She was unsure if mine is one of those. The issue is also in my duplex is another family the landlord increased the rent and stated that the lease couldnt be printed out for signature as the computer was down. They have been paying and also have yet to recieve the new lease. The other neighbor has her lease until Sept 06 and was told that if sold she would have to move before her lease expires. What is the law regarding selling duplex units with current lease agreements not yet expired? Can they just make them move. Also I our landlord keeps parts of deposit for lock deposit, carpet cleaning and apt cleaning once you move even if the place is spotless. Totalling approximately $150.00 of our deposits. If we have to move due to selling out are we not entitled to our deposits back if no damage? I also had asked for repairs due to rat damage and to exterminate the rats in my crawl space. I was told if I asked for any repairs then when my lease was up they would increase the rent on a month to month by over $200.00 which would force me to move? Just seems if they plan on selling they should have the courtesy to let us know whats going on rather than keeping us in the dark till the last minute.

Yes, thank you as I did find them. Only question now is since my lease is still in effect, if I send complaint regarding the rat issue via certified mail can he force me to move or increase my rent when my lease is up to an amount he knows is unreasonable? I couldnt find this anywhere or just missing any post regarding. I have had exterminator out twice now and he stated he spoke with the landlord that all openings on the outside must be sealed up before he could take any action to eliminate them. It sounds like WWIII in my ceiling at all hours and I swear one of them could carry off my cat that I seen in my garage lol. They come to hide out in the winter months every year and reign destruction on everything in my cabinets etc they can find a way into. This has been going on for more than 2 years that they even had to replace my lower kitchen cabinets where they ate a hole through it about 1 1/2 years ago. So it's nothing new. I'm just not able to up and move yet although I would like too.

If I have nightmares tonight I am gonna blame you!

I am not sure what exactly you want here. Are you really wanting to know if the landlord is going to retaliate against you by raising your rent if you complain about the monsters.. I mean rats? I don't know? Maybe? But can you prove it? It would not be prudent of them to do so however if you are month to month your rent is allowed to be raised.

Did you see this tidbit in your state's laws when you did your browsing?

83.51 Landlord's obligation to maintain premises.

1. The extermination of rats, mice, roaches, ants, wood-destroying organisms, and bedbugs. When vacation of the premises is required for such extermination, the landlord shall not be liable for damages but shall abate the rent. The tenant shall be required to temporarily vacate the premises for a period of time not to exceed 4 days, on 7 days' written notice, if necessary, for extermination pursuant to this subparagraph.

Looky here Lacie, if he is going to raise your rent anyway, why not raise heckfire. I am sure all those rodents playing soccer with your Grandma's antiques in the attic are against the Housing code in your area. hmmmm... are you catching my drift.

ROFLMAO. Love your humor Ty very much. Currently on a yearly lease which is up end of April so afraid if I grip with a certified letter and the fact that exterminator has been here twice which the landlord has not yet followed his recommendationss he'll not renew my lease. I'd love to move but financially unable unless I recind paying my sons tuition for his first semester of college and drop out of a semester of my graduate program also (the sacrafices we make for an education). May be best to wait out the month if he renews then raise some h double L then hit the code enforcement. He has threatened to raise it to an unreasonable amount to myself and other tenants if we ask for repairs yet a recent write up in our local paper of what a great property manager he is caring so much for his tenants and daddy being the zoning commissioner. Think we need a follow up on that story for reading. Anyway thank you again as it does make things abit more clear for me on how to deal with the situation for the moment. The cats a good hunter and has caught some of the small ones hmm maybe I should make one a gift for his desk decorations next capture? Wonder is a pretty red bow would due for a collar.
