What is the name of your state? Missouri
Five young adults signed a lease to rent a house and the security deposit was divided among them equally. They have all moved out and want their security deposit back, however, the landlord will only issue a check in all five names. One of the leasees (now working out of state) left his room in such a condition that the landlord is withholding part of the security deposit to have it fixed. The amount being withheld is in excess of his portion paid for the deposit. The landlord says she has to issue a check with all names on it unless all parties agree otherwise (she stands to gain $425 if the check is never cashed). I have two questions, first is what are the rights of the leasees (all college students except the one working/living out of state)? Obviously they cannot cash a check unless all parties sign. Second, is the landlord obligated to put all parties names on the check? In previous dealings with this landlord, her business practices are suspect and will be dealt with through the city and/or state as necessary.What is the name of your state?
