Landlord/Tenant Rent Dispute (Florida)


What is the name of your state? Florida

I am having some issues with my rental agreement. Namely, figuring out which months are considered the "first" and "last" months of the lease. I payed the "first" and "last" months' rent, as well as a security deposit, prior to moving in. I know that is a common practice with rental agreements, but the problem lies in figuring out which months those terms apply to. In the lease agreement, it states that "The term of this Housing Contract shall commence at 12:00 a.m. on August 13, 2006 and end at 12:00 p.m. on August 12, 2007." If one was to add all of the days together from August 13, 2006 to August 12, 2007, it comes up just short of one year. To one such as myself, who is by no means a legal expert, this would mean that I pay for 12 months of rent. Unfortunately, my landlord is insisting that I pay 13. In effect, I am paying 2 months' worth of rent for 29 days of living. Any suggestions?

I now see what you are saying. you have a one year lease and don't wish to pay for the last month because you already paid for the last month

Typically LL's collect a full first month and if need be pro-rate a second month to get the due date to the "regular" first. Last month is the last full month you are required to pay.

Also depends of the exact wording of your agreement re: these payments.
