What is the name of your state (only U.S. law)? Ca

Our carpet in our apartment is dirty with stains. Landlord claims that the stains are set in and can not be cleaned. She says the carpet needs to be replaced and costs $1500. I tell her we will steam clean. She says if that is the case a 1 year warranty is required, which is impossible to produce by the steam cleaners (no such thing as a 1 year warranty on a carpet, especially when people live in the apt). The best they can do is give a one month warranty.

Landlord says it's not good enough and will be replacing the carpet regardless. Is this legal?

If I produce proof that the carpet was steam cleaned and have pictures and a clean carpet, can she still go ahead and have the carpet replaced?

Thanks for your time.

She claims it is only a year old but that is very unlikely.
Then if you believe the carpet is older than what the landlord is claiming (1 year), it is completely appropriate for her to change the carpet.

How long have you been in the apartment?

Steam clean the carpets and take plenty of photos before and after. If the carpets turn out nicely and the landlord charges for new carpet, then sue him for whatever he attributed towards the new carpet and was applied against your deposit.

To clarify, if the stains come out, and only normal wear and tear is evident, there is no reason to replace the carpets.
