| | | lanlord/tenant lease I am a tenant in an multi family house and I have signed a lease agreement with the landlord for two years.
The problem is that I cant stand to live next to him and his nagging wife and want to terminate the lease early (1 year early).
Am I legally responsible for the balance of the lease????
Can he take me to court if he cant rent the place out????
Will i loose in court???
Please help!!!!!! |

A1) Read your lease.

A2) Yes.

A3) Yes.

you are stuck with the lease UNLESS the landlord lets you out of it, or they rerent the place.
Yes you will LOSE in court becuase you probably wont show up to defend yourself.
The landlord has a duty to mitigate his losses by trying to rerent....if you can prove he is not trying, then a judge can terminate the lease and the landlord eats the loss.
BUT youlive in Floriddddahhhhhh about the WORST state in America for tenants...
The landlord could let the place sit empty and force you to pay the rent month after month....
That would be Illegal here in NYCity.
So wadda u wanna dooooo?????
how about asking the landlord nicely to start advertisting the apartment, and YOU help show it, and get a new tenant to sign a new lease....then your lease ends..
A landlord cannot get rent from 2 tenants for the same place. | |
