Lead Paint Disclosure


I received a letter from the landlord stating:

Sorry we missed you, but we need for you to come to the office as soon as possible and sign a Lead Based Paint disclosure form and to receive a brochure on Lead Based Paint.

What are the dangers of being around lead based paint? i think that they are preparing for painting. I would like to know what the effects of the paint are.

Jeeze....have you been in a cave for the last 50 years?

Lead is dangerous and our federal government has devised a cute, little booklet that you must sign for if you are renting a property that was built pre-1978. No big deal.

Landlord just has to disclose if he knows there is lead at the property - not fix it - just tell you not to lick the walls.

There are all sorts of resources on the web and the best one is the HUD/EPA website where you can download the booklet yourself.

It's not that i have been in a cave for 50 years, I am not that old, and was born when made the laws. i know not to lick the walls, but am concerned that they would be using the paint. Now, I don't know if the paint is even still made, that is the reasoning behind this post.

First, is the paint still made? I think that it is illegal, and is not, but i could be wrong.

Please understand that i am not trying to be ignorant, but would like the information. My apartment complex is going to start painting, and the fumes invade the halls. I just don't want any harmful side effects from the fumes, that is all...i don't plan on licking the walls.

Just like lead in gas, no paint has contained lead since 1978 and Paul McCartney was with a group before "Wings".

The horror stories in news about lead in children's blood is actually coming from other sources other than paint - dirt, third world candles with lead in wicks - loads of other, more primary sources than paint that might have been put on walls 25 years ago..

Contrary to cvilleCPM's 'pro-landlord' stance, I think you have a very good position.

How good depends on several factors.... like WHERE ARE YOU (read the RED text at the top of the screen!!!). I had to go back to your original post to see that your location is Minnesota!!!

Finding lead-based paint in your home is VERY serious and a health risk to the tenants. Minnesota has some pretty stringent requirements. They are covered in statute 144.9503 and 04 at the following:

Simply, if your landlord has to advise you that you COULD have lead contamination, you have certain rights that you need to consider.

Since you are already a resident and if the mgmt is going to disturb more than 2sqft of common hallway/or repainting individual units in a pre-78 property, then they have to give you booklet and have you sign a RECEIPT. This is NOT the same process as when you are signing a lease to enter a pre-78 property - don't mix apples and oranges.

This second step of the federal regulations went into effect 2+ years ago and has not really been modified on a state level.
