Lease Buy-Out?


Arizona.

My daughter is renting a house together with another girl. They're not getting along, and my daughter is unhappy with the arrangement, wants to know if there is any way she can get out of it. The lease is for a year. The other girl signed the lease agreement since my daughter was in another city at that time.

My daughter asked the roomate if she could look for another person to replace my daughter, but the roomate indicated that she's not willing to do this.

Does my daughter have any options here, or is a lease like a prison sentence where you have to serve your time?

I'm wondering if she could do a Lease Buy-out, or maybe go from a one-year lease to "month-to-month" ?

It sounds like your daughter did not sign the lease. It she listed as a tenant or occupant? Any negoaitations with the lease needs to be done with the landlord.

My daughter is referred to on the lease as "roommate".

No, her signature is not on it.

But she feels a moral obligation to stay around for a while, until another roommate could be found. The problem with that of course being that the other girl doesn't want to make the effort to find someone else.

She has signed checks, in paying for utilities on the place- I don't know if that has any bearing.

I'm just wondering if my daughter could do something like a buyout on her part of the rent, since she did make an oral agreement on her part to stay there a year.
