| Looking for advice on an ex-roommate issue My name is Danielle and I live in Massachusetts. I currently live in an apartment where the lease is up for the 31st of August (this month). When i first got this apartment i signed the lease with a friend of mine on September 1, 2005. After a few months he came to me and said he did not want to live with me anymore. I said okay but he needed to tell me exactly when he was moving out so that i can try to find a replacement. He said November 1st 2005. So i started to look for a roomate, no luck, so i started to get worried. Then he told me he needed to stay another month, I said okay because i needed someone to pay rent. He finally left December 1st leaving me without a roomate and stupidly paying the rent on my own with the help of my mom. Now he is calling me asking me to return his 400 dollars that he paid upfront at the signing of the lease for the last months rent. I really do not think he deserves this. But, i dont want to avoid him and end up in small claims court. So my question is is he lawfully entitled to that money?? I thought i read in Massachusetts that if you break a lease and move out you need to pay rent until a roomate is found. Is that true??? I am very confused. If anyone can answer this I would truly appreciate it. Thanks in advance.
