Management Leased My Apartment Before I Vacated


CALIFORNIA

I was on a 3 month lease at an apartment. After 1 month, I gave them a 60 notice that I was to leave. My lease ended on September 20th.

On August 20, I told them that I could vacate the apartment by
September 1st (since I got a different apartment), but CAN STAY TILL THE 20th TO AVOID BREAKING THE LEASE.

They were thrilled because there was a tenant wanting to rent the apartment when I moved out (Sept. 20th).
One of the management called me to tell me that the tenant wanted to move in on the September 1st instead, and if I could clear out the apartment, they could do the 2 day cleaning, and have it ready for the new tenants.

I had almost everything out on August 28th. When I returned to get the remaining things and return the keys, someone was in my apartment.
My possessions were in a pile in the living room, and the painter was there. He did not have my permission to enter and he said the management gave him permission. It was the only the 28th, and clearly, it was still 'my' apartment, at least till the August 31st. I moved out completely, and returned the keys on the 28th.

Now, the apartment management is charging me 2 months rent, plus a penalty for breaking the lease.
The renters ended up moving on the 20th instead (not my fault).

Is it also breaking and entering since the painter was there before I moved out? What can I do?

Let the LL take you to Court , or you take the LL to court If there's a security Deposit held by the LL, and let the Judge decide .

State the Facts as you Stated them here .

Ask for any additional damages that may be due you by Law from the LL .
