"Month-to-Month Fee" Legal on TAA Lease?


What is the name of your state? TEXAS

We have a Texas Apartment Association (TAA) lease with an apartment complex in San Antonio, TX. The lease requires a 60-day move-out notice and the lease term ends 12/25/05. To continue the lease month-to-month, the landlord is charging the market rate for our unit PLUS a $100 “Month-to-Month Fee.” This “fee” is not stated in the lease agreement, and we weren’t aware of the fee until November 7th which is too late to give a 60-day notice to move-out on 12/25/05 when the lease ends.

Is it legal for the landlord to charge this fee on top of the market rate?

< Our TAA lease expires 12/25/05. We gave 60+ days notice yesterday to move out 1/29/06. We do not owe any money to the landlord.>

The term "month to month" fee is a new one to me, but all I can say is that in Texas a landlord can actually charge whatever they want when a lease expires. I looks like for January you have a hefty amount to pay.

If I am wrong then someone will come along and call me a ninny.
