I live in the Bay Area, CA, and am moving out of my apartment soon. I have a few questions:
1. Once my landlord and I do the final walkthrough of the apartment, and sign off on the paperwork, can he still change information regarding the state of the apartment? I.e., we walk through and determine that the condition of the apartment is good, but, say, a week later they discover a burn or rip or whatever. Can the landlord seek penalties for that?
2. For a while, I was in breach of lease and smoked in my apartment. This was a definite no-no, and I am a pretty good tenant but everyone else told me that the manager was cool about it so I could go ahead and do that (OK, I am stupid). So I did for about 6 months until the landlord got mad at everyone smoking, threatening evictions, etc., and the manager warned us to stop smoking...so, my manager knew I was smoking, it was against the lease, but he was OK. Now that I am moving out, he actually did sort of a walkthrough the other day and said the place smelled like smoke, so they'll have to clean the walls or carpet or something. That's fine...I mean, it's my fault for smoking, but I was just wondering can I legally get into trouble for this? |
