My Roommate(s) won't pay their bills!!!

About a year ago, I asked my very good friend (the person I plan on taking to court) to move into a new brownston with me. She said “I’ll have to think about it”. So I prepared a “proposal for tenancy”. This document was done in a “cheeky” fashion, but outlined all the benefits of my townhouse in comparison to her small apartment, and explained what I would do for her as a "thank you" if she decided to move in. This document specified I would pay her car payment for July, pay for all moving expenses, make all arrangements for moving, and put $200 towards the “heating oil”. After reviewing this document, She decided to accept my offer. This was agreed upon in July, and she moved out of her apartment in Aug. I put all her stuff in storage and she lived with her parents until she moved in on Oct 2004. I (we) soon discovered the heater didn't use oil, rather it ran on gas. The hot water heater, stove, and clothes dryer all ran on gas as well. The gas, and cable were in my name, and the electric in hers. Then, tragically her mother was diagnosed with lung cancer… this was very hard on her, naturally. She was not working very much, and as a result and had very little money. I was sympathetic to her, and didn’t have the heart to ask for any money from her. Keep in mind this is one of my best friends, so it wasn’t out of the ordinary to lend this kind of money, especially under such circumstances. Then, sadly, her mother passes away in March. It was very difficult to watch her go through this, and I still couldn't bear to ask her for the money - yet. Now, this is where things got really tough! She asked me if her boyfriend could move in… and, that if I said "no" they would leave to get their own place. So, I said OK as long as Dean (The landlord) agrees to it, and as long as all bills are paid 3 ways. They said Dean approved it (they never asked him) and agreed to my request. Brian moved in April 1st. Then, they got a dog (I have a cat that is terrified of dogs), I said “did you get permission from Dean”? They said yes (again they lied). Dean got upset that there was a dog on the property without his permission, and they moved out. I never got any money for the gas which runs the Heater, Stove, Laundry Dryer and Hot water heater. I’m also stuck with the broadband bill for Cable, Internet, and Phone. The Gas charges totaled $1,700 and the Cable $1,500. She claims I said I would pay the entire gas bill in the proposal (nobody has a copy), and that she's not paying. I told her she is gravely wrong, and that I would never agree to pay for all the oil concidering we live in New Hampshire, let alone all the gas. We bickered and i told her I would settle for $700.00 because of all her tough times. However, I made it perfectly clear (in a written document) that if she didn’t agree to pay the $700.00 now, I would take her to court for the whole amount owed to me. She agreed to pay me $84 per month for 9 months ($756). Then, her boyfriend called off agreement and wants to go to court.

The way I see it is I’m owed 50% of the bills from Oct-April (less the $200 I promised in the proposal) and 66% from April - July15th.

I have all documentation from the Cable and Gas companies… Will I win?

Just on a gues... I would say you have a good chance of winning...

You need to bring ALL your documentation with you to court, don't leave anything out... Even if you don't think you will need it, bring it! Aslo, try to get a notarized statement from the LL stating he Never agreed to the 3rd tenant(the BF) nor the dog in the house... This will corroborate your end of the story...

As for the bills, you are correct to assume that they would be split amonst the total number of tenants for the unit UNLESS there is a written agreement...

Yeah... I have everything i can think of in order, and ready to bring to court.
I'll let you know how everything goes. BTW... How long will it take to get a court date? I filed on Fri?(08.05.05)
