Need advice regarding violent roommate - LI, NY

I live in a house share, which I believe is technically an illegal apartment in our area, since we have no lease. As far as I know, this means our landlord has no legal recourse with terms of eviction, but also isn't prevented from removing someone in violation of NY eviction law.

We have a violent, unstable roommate who has threatened us all verbally and physically on a number of occasions. He also moved another person into his room without permission, and is dealing drugs out of the house. After about 6 months of complaints, the landlord instructed him to move out at the end of this month.

We are very afraid that he will do something to harm the people/animals in the house, or damage our property or cars, either before or after he leaves. Is there anything we can do? We are hesitant to go to the police, as it is technically an illegal situation, but we require some sort of protection or record of these threats, in order to hold him responsible if anything does happen.

Also, is there a clause in eviction law that voids a person's rights when threats of violence and intimidation are made on their part. It doesn't seem fair that landlords can't harrass you or threaten, but there's no law protecting you from TENANTS!

There have been prior physical confrontation initiated by this " alleged " violent person , yet you have NOT called the police , filed a report and obtained a R/O .

A R/O would have forbid this person to reside there , plus the LL would have teeth to evict .

As it is now , the LL has given notice to vacate , although it's unknown if it was proper notice .

Either live it out , or move , or if this person becomes physically violent again there , call the police , and get a R/O the same or next day .

If the place is illegal the LL can not collect rent or hold you to the rental terms .

Of course you'll need proof the place is illegal to rent .
