Need Tenant help. Complicated situation!


What is the name of your state? Maryland


Well I let a friend of mine stay in a room in my apartment and he pays rent every month. I
told him about utilities on July 24, 2006 and he told me he was moving out on the 4th of
august. I told him he would have to give proper 30 day notice and still have to pay August
rent. He refused and then I talked to his father and his father paid it. I asked him a couple of
days ago when he was going to leave because he DID NOT leave on the 4th as said. and he
refused to give me a date and has still NOT written notice of leaving. I typed a letter for
him to sign and fill out with the date he was leaving and he refused it. I want to know if he
has not moved out on August 24th can I take his belongings and put them on the lawn since
he gave oral notice and would not have left by then....or is oral notice just not enough which
would mean he would still have to pay for septembers rent also since he has not given
proper notice???!!??

No, it is illegal to do so.

Proper 30 day written notice is required. The notice should include one full calendar month. If the tenant wants to move out on or before August 31, the notice should be given on or before July 31.

Your friend is now your subtenant and you must follow Maryland Landlord Tenant law.

You can terminate your subtenant's month to month oral lease with a proper 30 day written notice (60 days for Baltimore City). If your subtenant does not move out willingly, you are going to have to file for eviction.

If rent is not paid, file for eviction due to non-payment of rent.
