Greetings to All.

I recently posted with questions about upcoming eviction proceedings being brought by us to our tenants.

now I have a question about "holdover".

The court date has yet to be received and [to our knowledge] the tenant has not been noticed either.
Our complaint states non payment of Feb. rent.


It would seem that they will not be out by the start of March either.
NJ law allows for double rent in the case of holdover.

Do we have to bring a seperate case for the holdover or can that be heard at the same time as the non payment hearing?

Do we add our late fee for Feb AND base any holdover rate at the new [inclusive of a $75.00 increase] rent for March PLUS the late fee for nonpayment in March.

Yes an atty. is making our filings but I wanted to learn about this issue before asking him about it.
