normal wear and tear??


State: Indiana

I recently moved my girlfriend out of 1/2 of a duplex in Indianapolis. The landlord is now saying that she is not going to give back any of the deposit due to damage and other issues.

The main question I have is about window and door screens. She lived at the location for 10 years and during that time the landlord put just as much as she had to into the place. Well, after 10 years some of the screens had come loose. We replaced the screen on the screened porch door twice, but the rest of the porch screens had areas that were pulled away from the frame. There were some window screens that were also in the same condition from wind and weather. The landlord came over multiple times for water leaks and similar situations and never mentioned the screens.

Is this wear and tear or is this something that the tenant is responsible for?

**A: it is wear and tear as long as she did not damage them. Any kids?

How EXACTLY were these screens damaged?? If damaged due to any action on the tenants part (kids, dogs, fists through them, etc.), then they are damages and can be recovered by the landlord. However, if they were simply 'worn out' due to natural causes, that is 'wear and tear'.

I feel worn out after reading these types of threads were the facts are not provided and the story is tilted to one side.
