Only tenant required to obey rule.

What is the name of your state? OREGON

ORS 90.262 (1)(c) says that when a landlord enforces a rule it must apply in a 'fair manner' to every tenant.

I had a note posted on my door saying that I had to remove specific items from my patio area. I looked around the complex and several other tenants have the same items. I am the only tenant to receive the notice. I don't want to ignore the notice but I also don't want to be singled out. There is nothing in the lease about the items they are talking about.

Should I file a complaint because I am the only one that has to do what they want? What should I say to the landlord, if I do file a complaint?

Go take pictures of the other patios and have the pictures dated and send LL a letter keep copy explaining that you have pics that show other units doing the same thing (After you have complied) and a copy of that statute and ask the LL to enforce it with all or drop the issue . send the letter at the very least using a certificate of mailing OR registered ret rcpt .

Thanks FarmerJ.

While my thread is still fresh, I'd like to know what I should do if the manager doesn't reply AND/OR refuses to withdraw the notice?

Can the landlord refuse to renew my lease because I filed a complaint? What can I do if the landlord refuses to renew my lease?
