Our commercial building sold.
We have a lease till 2008. :D
New LL need to build and converting to residential.

He suggest - free rent till June 2006 and we're out.
I'm thinking "free rent till June" my ass.
Now I know how I'm dealing with.

In order for me to move and based on the nature of our biz,
I need 2-4 month and at least 200k just to build new space
so my biz can function as before..
This what was invested in the space we're now.

Also in the lease it says - they can't make noise.

I'm I looser here or a winner?
Can they just ignore us an start construction?

Thanx.
I mean a lot.

Q: I'm I looser here or a winner?

A: I don't know if you're looser; were you tighter before?

Q: Can they just ignore us an start construction?

A: Yes.

Negotiate an early move out fee, say starting at $250K.
Guys, I appreciate your human support,
but what on the legal site of the situation?
Professionally speaking?
Does this lease giving me some power to negotiate things in my favor,
and to make them to hold their horses with construction?

Or I can just wipe my butt with this paper..

I thought they have no choice, but how it works in real life.

**A: your lease stands intact and is not terminated due to the sale, unless the lease contains a termination due to sale provision.
As to the construction noise, that is permited provided the property owner and/or his GC obtain all the regulatory permits.
