Outrageous conduct by landlady


What is the name of your state? Oregon

Last October our landlady raised our rent without a written 30 day notice she raised it with a 2 week verbal notice. when we moved in we signed a mtm agreement.

we always paid our rent on time every month. our landlady came to us on January 30 and told us she wanted an exta months rent when we paid it feb 1 because she said she didn't make the payment on the rental house we lived in.

We told her we could not afford to pay double rent becuase we had bills the landlady got mad and was screaming and cussing out in the yard and stormed off. On Feb 1 we wrote a check for the feb rent only. the next day when we returned home from doing errands we found a eviction notice to move on our door and the reason she stated for the eviction is we refused her offer.

It was stated in the eviction notive. that our written rental agreement that we signed when we moved in had expired and we were now on a verbal I found the agreement and were not on a lease we were on a mtm and she wrote in that there was no expiration day on the agreement. she never ever told us nothing about a verbal agreement.

my husband was hauling out our appliances (we were almost totally out and had a few things like my glassware and a few fragile things in the cupboard) the landlady came in to the house and was packing up our stuff and removing it from the house. . I jumped the landlady and told her to leave my stuff alone she said the reason she was doing it was because we weren't moving fast enough and she would not listen when I told her that I am disabled and doing the best I can. and we did pay her prorated rent for the days over.

she told me if our stuff wasn't out that night that she would throw out in the street and I told her that was illegal and she said I can do anything I want. she just threw fragile things in a box she broke my steroe and she stole some stuff

when my husband was trying to throw some trash into the garbage she forcably stole the trash can out of his hands and told him he could not use the can to throw out our garbage but here is what really makes me mad is that garbage can was ours that the garbage company brought to us it was in our names we paid the bill the garbage account was in our names we paid all utilities for this house no utilities were included in the rent and our exland lady has the can. and we will probably get charged for it being missing even though we have called the garbage company.

the landlady followed my husband around calling him names and calling us names because I have nicer furnature than her and she was putting us down for our disabilities. She also yelled at my husband for a stain on our couch (thats right the couch is ours that we paid for). We stayed up until 3:00 am trying to get our things out because I was afraid that she would destroy it.

we paid a $350.00 deposit when we moved in and we will never see a dime of it because the landlady woudl not let us clean the house. She forced us out and threatened us with arrest if we did not leave that night. I think she did this to mess us out of the deposit.

She did not go to court to try to get us out. this was not a eviction for non payment of rent. She was evicting us because we would not bail her out of her financial mess. I know this sounds crazy but I am not making any of this up. I have heard rumors that she is into drugs which may explain her behavior.

Before we rented this house we were warned by several people that do not rent from her because they said she was nuttier than a fruitcake. Any Advice please because she should not be allowed to steal people's things. This landlady tries to control every aspect of a tenants life.

Skeeter, could you edit your post to make it easier to read? There's this nifty key on your keyboard labeled 'Enter'. Use it...it makes all the difference in the world, when you change a ramble into a more easily readable format. Also, stick with the facts...we don't need to relive your tenancy.

So I see you did edit your post...
The problem is that when there is a situation with LL and Tenants a paper trail is needed...
There is no such thing as a verbal lease.
I am still not clear on what you want.
Did she take some of your property?
If she does not send you notice of what she is taking out of the security deposit, or a refund of any or all of the monies in the security deposit within 30 days you can take her to small claims courts... (have receipts?)

It sounds like she did not follow a lot of the LL/tenant laws... but you did not look up your rights and let her bully you.
Next time a lot of the personal stuff can be left out of your posts.

I did to


I did to keep a paper trail. What do you mean I let her bully me. I was told by people when I asked for help that a LL can kick you out for any reason. I have been trying to get help. I called the sherriff dept since the city the rental is in has no police dept. re-garding the thefts. I was told someone would contact me and they haven't I plan on suing for everything I can get. If I let her bully me then please explain why I told her if came around me I would personally rip her head off. You know what else the skum sucker has done we contacted the electric company last week to turn the power off or at least take it out of our names. I found out today that thanks to a little stunt she has pulled that the power is still on and will be for another week and the electric company told us that we have to pay for her usage because she went into the house opened up all the windows and cranked up the electric heat. Thats right I am being forced to pay for her doing this and that will be one more thing that I will nail her to the wall for. What I wanted to know is what can I do legally to her from civil to criminal geeze WHAT PART OF THAT DOESN'T ANYONE UNDERSTAND!!!!!!!!!!!!!!!!!

Section 90.375 has some info that might pertain to your situation.

Because you have problems with utilities, theft and being forced out, I think you should consult with an attorney or legal aid in your community. You are dealing with a difficult person and complicated issues. From what you've posted, you shouldn't have a problem finding a lawyer.

You should have called the sheriff's Dept. when she came into the home .

All you can do know is sue for your damages .

As someone pointed out , familiarize yourself with the LL/tenant law regarding the return of security deposits .

Wait until the time has expired for it's return , then take the LL to court .
