quit and vacate notice

What is the name of your state? South Dakota
I went on vacation, and forgot to pay my rent, I am 4 days past the deadline for late rent, which is the 5th. On the 9th they gave me a quit and vacate notice, I have been told that they can't do that untill the 10th of the month, are they breaking the lease by sending it early? I can pay the rent and ignore it according to the landloard, but I have a nicer place I want to movre into, if I can get out without being responsible for the rest of the lease I will do it, but I don't want to be held responsible.
