Raising Security Deposit after living in apt. for 7 years. Disabled with pet &Dr note


What is the name of your state? California, I have a queston we live in a moderate income housing complex (HUD) approved and the rent is controlled to a degree and based on income. Recently myself and a few other tenents have aquired small dogs, i have a chihuahua 3lbs. my complex will only allow animals such as dogs with a doctors note. I have a note because I have a 7 year old son who is deaf and his new school said getting him a pet would help him socially and emotionally so my doctor signed a prescription note for my manager. Well recently we have been told that our SECURITY depostis will be raised.....now they know that they can not by l;aw charge us a pet security deposit because we or a household member is disabled but they are going to raise everyones security deposits although I have lived here for 7 years...can they raise a security deposit after youve been living somewere for 7 years???? They are doing this to the entire complex but have said unoficially its because to many people ave pets now. I am on a month to month here technically.

There is nothing in California law (I'm a Californian myself) that allows a landlord to raise the security deposit.

If they want to keep dogs out, they could probably get away with it by giving tenants adequate notice that no more would be allowed in the complex. They could add a "grandfather" clause, which means that people who owned dogs already could keep them but couldn't get another one if something happened to them.

I strongly disagree that a chihuahua is a good pet for your child since they are known to be high-strung. There are what are known as service dogs that are working partners for the deaf. These dogs are protected by Federal law and can accompany their owners into a grocery store, for example. They form a very close bond with their owners, but their main purpose is to be an assistant, not a mere "doggie."
