Removing relative from apartment where there is no lease

A woman has allowed her niece who has a young child (age 2) to live with her. She has a small condo. The niece pays no rent and refused to enter into any kind of written agreement with the aunt. The aunt has allowed her to live there because she is concerned about the welfare of the 2 year old. The niece is now coming and going as she pleases, has left the 2 year old in the middle of the night with the aunt without letting the aunt know and has broken the door in a fit of anger. She refuses to respect any of the "rules" of the house. She has informed her aunt that the aunt cannot make her move out because of the tenant landlord laws that prevent the aunt from evicting her. She gets her mail at the aunt address and uses this address for her other "benefits". The Aunt is at wits end and while she fears for the child's welfare, she is getting tired of being taken advantage of, of having her own items abused and mistreated but doesn't know how to go about getting the niece out of the house. While I am not sure she will even take the steps to remove the girl once she has the information, she at least needs to know what her rights are. Any help here or referral to information for this woman.

This lady needs to first go get a post office box and have ALL her mail sent to it, WHY ? besides using it has her address for when she sends the niece proper notice telling her to get out she does not want the niece to have any further access to any thing that can be stolen and used to steal identity, yes relatives actually do that kind of crap to other family members especially when the family member has been helping them in some way. then any thing that has SSNs or other information on it that's in the apt should be gathered and locked in a safe or bank box , then she should send the niece proper on paper notice , it can be hand written too but should be very simple and clear (Date) ` Niece dearest ( think mommie dearest LOL) this is your notice that you are to vacate my home 12345 Dracula drive Unit # Frankenstienville KY (zip code ) (Date) signed the aunts name NOW in your state government web page links there should be landlord and tenant links , the amount of notice to be given would be the same amount of notice one would give a month to month renter who doesn't have a written lease and she should make a copy and store the copy away from the apartment along with the certified post office receipt , WHY because its handy to have them together for proofs for court. NOW the other reason for the post office box is because if the niece decides to refuse to sign for or pick up her certified mail then it will be returned to the aunts PO box where it will be safe from the niece destroying the notice since when it would go to court the aunt would tell the court not only had she told the niece it was time to move but the niece refused to pick up her mail when proper notice was sent out. The court would likely want to see proofs and the aunt would have to offer to the court the original notice that was returned by the post office to her still sealed in its original envelope then likely would just carry thru with a eviction order anyway. If dearest niece does not take care of the child or neglects the child hopefully anyone who sees it or discovers it will call the authorities and let them do what they have to. (Time being Id suggest you find some one friend or relative of yours or hers that can go install a dead bolt in place of the aunts bedroom door knob so she at least has one area that she can secure. )
