| | | Rent Forgiveness Agreement I live in NYC with 2 roommates. Collectively, we owe several months in back rent to our landlord. In lieu of litigation and eviction, he has offered to forgive our debt to him in return for our vacating by a specified date.
He sent a simple contract for us to sign, but I'm not sure if it is enough should he be sneaky and take us to court for the debt anyway. The meat and potatoes says "you will vacate the above apartment at the above address within thirty days and the eviction proceedings will be terminated."
Is there a standard contract for debt forgiveness, or is there a particular way this should be worded so we can simply close the book on this? Any help would be appreciated. What is the name of your state? |

| | | At a minimum, your "agreement" should state that all prior rent debts are forgiven in exchange.

| | | Thanks! I'm not familiar with law- I really just want something that will hold up in court should the need arise. All my googling showed up was "debt forgiveness between multinational corporations and such...I just wanted some bare bones info without having to pay a lawyer. |

Have him reword the agreement .
All tenants and any occupants of said address will vacate and relequish possesion By X date in exchange there will be no action(s) taken to recover rent owed .
Signed and dated .
