What is the name of your state (only U.S. law)? California

We have a very arrogant tenant... he had bad credit and the only way we would consider him was for him to give us 3 mos rent in advance and 3 mos rent for deposit he paid it gladly... his 3 mos of rent paid in advance has been used up... his 4th month rent was due November 1... on the 3rd day after due date which is today a late fee of $50 plus $5 for every day rent not paid is due... Tenant has been a very rude person... always barking how we abused him by charging 3 mos deposit... and he wanted to use that for rent... have told him that amount was deposit not anything else and nowhere in the lease does it say he can insist on us using that money for rent... he has not paid his rent for November... what is the best course of action??
 


if the unit is unfurnished then you are ONLY allowed to collect 2 times the amount of rent for deposits...not 3 times.

you both used each other and now you both get to lay in the bed you made. i'd suggest you get more familiarized with civil code 1950.5.
