Is it legal to offer $50 off the rent for "exceptionally qualified" renters?

I'd like to attract renters who have a habit of living longer than a year at previous addresses and who are willing to sign a no smoking indoors lease addendum, without strictly requiring it as a condition for accepting prospective tenants.

Smoking status is not a protected class in your state or this context.

Offering lower rents to candidates with credit scores or rental histories that are exception is not discriminatory either.

Ensure the guidliness for what is exceptional is defined and universally applied and it would seem that your plan is ok.

I would suggest you have a lawyer review your plan and your smoking lease addendum.

Talk to your atty about creating a well worded signing bonus that is payable as rent credit at the end of the lease, Keep in mind that you may want the atty to word it well enough that it gives you zero hassle and gives the tenant more reason to sign a renewal with you later on.
