What are the rights of a renter in Indiana in regards to eviction. I need to know the proper process that is supposed to be followed.

when were you supposed to pay the rent?

There was a lease that expired some time ago. No new lease wwas signed. WE continued to pay rent due on the 15th of each month. Due to unemploymnet some rents were payed late at this time we are 5 days late with the current months rent.

Well you owe the money the landlord want it, so what are you going to do about it?

You are a month to month renter so move, it will only get worse. Judges will allow you to stay if you pay ALL the rent......ALL the rent.... plus legal costs BEFORE you have a trial...IF you have a lease!

But judges since you have no lease will say pay up and get out...

So Pay the landlord what you owe, get a release take pictures of the apartment,and sell your stuff on http://www.ebay.com

I guess you need to be reminded the #1 rule in Life Skills:

THE LANDLORD ALWAYS GETS PAID FIRST !!!!!!!

YES ...ASAP!

The landlord will take you to court and get a judgement for the owed rent damages and legal fees and then will get a marshal or sheriif to throw your stuff out usually within 72 hours after court......then the landlord will try and get bill collectors after you.

Best deal, Pay the rent today, or get a signed release that you will be out in 10 days, in exchange for the landlord keeping the security deposit.

You need something in writing......

Or take you chances with a judge.
