Roomate not paying rent


What is the name of your state? California

My roomate and I have a lease that ends in six months, Sept. 05', but he has been very negligent in paying rent. Our rent is 1,900 a month and a deposit was required to move in. I paid all of the deposit, $6,200, myself with the verbal understanding that my roomate would pay me back. He has never paid any of the deposit back and has actually broke a door in the house. I paid my part of last month's rent but he did not and he now owes our landlord $880 including late fee. My question is, if he continues not to pay the rent is my deposit at risk? If so, is there anything I can do to prove the deposit was paid in full by me? I have a copy of the check that was used to create a cashier's check for my landlord. Is there any way I can get out of my lease? Somebody please help, this roomate is costing me alot of money.

Uh oh


You had better look at your rental agreement/lease... it usually says that you are both responsible for the rent.

Your roommate may get a 3 day to pay for the 1/2 of the rent (maybe has already and has not told you)... but you both will be responsible for the apartment until he signs off of the lease and signs a relinquishment of the deposit. Then you would need to get another roommate and put them on the lease.

As far as the deposit goes, if the reciept you received has both of your names on it, then the deposit is in both of your names.
Right now the deposit is not as much at risk as the keeping of the apartment due to non rent.
Jeesh 1/2 into the month and he hasn't paid yet... what the heck!

if evicted...


In California

Thank you for replying!!!! If evicted because of non-pay of rent would I lose any of my deposit? I'm not really against be kicked out because of the rent situation, I'm realiable not him, but if we were kicked out would any unpaid rent be taken out of the deposit?

You don't want to get to the "eviction process"
You will probably get to the 30 day or 60 day to leave part of the process.
Then Leave
Its terrible that your rental record has to to be messed with, see if you can speak with the LL about keeping your side of the story clean.
Evictions are not clean!

Read the above link... it is a very clear and understandable handbook.
It describes what they can and can not do with your security deposit as well.

THANK YOU SO MUCH!!!! I got so lucky to find this website. I never thought my questions would be answered so quickly. I think both were answered in about 30 minutes. It is very much appreciated.
