roommate not paying last month's rent


What is the name of your state? Idaho
I've been living with the same roommate just over 2 years. We were renting together where we were on a month-to-month rent and were evicted in May. I bought a house and my roommate moved in with me. June was free as my first mortgage payment wasn't due until July. I did not charge my roommate rent in June as a kind gesture. My roommate's 15-year-old sister moved in for the summer for free as we had agreed upon at the end of June. My roommate then approached me mid-july asking if her sister could stay indefinitely. i said no and my roommate was moved out with her sister on July 29th. Before moving out she verbally agreed to paying bills owed totaling $40 and August rent totaling $350. She has since taken back the offer to pay August rent and we don't have a lease. Am I protected at all and/or able to win a small claims suit?What is the name of your state?What is the name of your state?

I don't understand what you mean by protected.

Small claims cases are won when the plaintiff (you) has enough evidence that convinces the judge that you are telling the truth and that the money is owed from the defendant (ex roommate).

You would have the burden of proving that the defendant owed and agreed to pay what you are stating here.

The problem without having anything in writing is the defendant's story will most likely be different than yours.

Your only choice is to take the former roomate to small claims court and make a claim based on your roomate having a month to month rental with you and didnt not give you proper notice about moving so you want to have one months rent awarded to you. Us any and all written documentation from your past 2 yrs . like say your copy of a rct book, old deposit records if they paid you by check.
when people have just oral rental agreements it takes alot more work to be able to prove things . so thats why use of old records could help you show a court that you did indeed are in a LL/T relationship and are owed the money.
