I've been living with the same roommate just over 2 years. We were renting together where we were on a month-to-month rent and were evicted in May. I bought a house and my roommate moved in with me. I don't understand what you mean by protected.
Small claims cases are won when the plaintiff (you) has enough evidence that convinces the judge that you are telling the truth and that the money is owed from the defendant (ex roommate).
You would have the burden of proving that the defendant owed and agreed to pay what you are stating here.
The problem without having anything in writing is the defendant's story will most likely be different than yours.
