Security Deposit Before Lease was Signed

We found a house that we were interested, and it was available on a lease or a lease option. We were considering the possiblilty of doign the lease option. They had us fill out the credit application and they asked for a 2000.00 security deposit to hold the house while we were hammering out the details on how the lease option would be structured. We couldn't come to agreement on the lease option terms and so we decided to pass on the home. Well they cashed our 2,000.00 check and have not responded to our repeated calls in regards to the refunding of this money. There was no lease agreement signed so aren't they required by law to refund this money?? Please help. How long would they have to refund it? ANd what recourse actions should I been taking at this time?
