Security depsoit deduction for Dirty Carpet


What is the name of your state (only U.S. law)? NJ.
Hi,
When we moved into an Apartment we found , the carpet was unclean and dirty. as we didnt have any place to stay, we signed the lease and moved in immediatly. then we requested for the carpet change. but no action were taken on that. we are moving out of this apartment by September.
Now the land lord charging us for the Dirty carpet. how do we handle this?

If you have pictures, allow the deduction then sue him in court. The problem with you story is that it is going to be hard proving your point, without photos. The landlord can argue that the carpet wasn't dirty when you moved in, and will most likley have photos. Or he can argue that since you moved in, the apartment was in a good enough condition.

Need you help.
Take good quality photos / date-time stamped , or with a current newspaper date in the photos .

Depending on the age and condition of the carpet , will determine your liability .

Also , if you requested replacement in writing , and have a copy , that may help you .

It will be up to a court to decide .

You can always find a professional cleaner w/ discount pricing , and keep your receipt , instead , if the carpet is worth it .

You may want to get a free estimate , if they offer it in your area .

If the carpet isn't worth it , have it noted on the estimate .

**A: do you have an inspection report and photos of the carpet condition when you moved in?

Since it costs money to file against someone, wouldn't it just be easier to have the carpet cleaned before you move out, then take pictures of the cleaned item?
