squatter's rights??

What is the name of your state? NY

A friend of mine allowed a "friend" to move into her home over a year ago. Recently, she has found out that he has been pilfering money, and lying. Enlisting the help of her son she would like to have this "friend" moved out with as little fuss as possible. She is unsure about squatters rights in NY State, or if he will try to invoke them once the cat is out of the bag. There is no signed lease, only a work agreement with her attorney

She is unsure how to proceed. :confused:

Suggestions would be much appreciated.

The friend is a tenant and has rights as such. The owner must give the friend proper written notice to vacate per state laws, and if the friend refuses to move out when the notice expires, she can file for eviction through the courts.

She is a lovely, kind elderly woman. The attorney agreement stated that he would chauffeur her to Dr. appt.s in exchange for room and board. He has not fulfilled that part of the bargain.

He has directly violated the stipulations of the agreement, do tenant rights still apply in this situation?

Was it for room & board on a monthly bases , weekly bases , or opened ended poorly written room & board ?

She says "open-ended".
If it's an actual contract and it was breached , request the person to vacate immediately .

This happens too where person(s) are hired by an Apt. community and given an Apt. as part of the agreement .

If that person quits , or gets fired , they have to move .

If they do not , contact the Attorney that wrote the agreement to get that person out .
