What is the name of your state? New Mexico I have lived in my apartment for 5yrs 4 months. When I first moved in here I would over pay my rent so if I have a bad month I would at least be cover for part of the month. I stopped paying extra 3 1/2 yrs ago. I have tried over and over to get the money they have which is almost $400. They keep telling me they don't have it. I have the rent bills and my reciepts and I gave them the real ones once they made copies. Then 2 more times I gave them copies. Last month I was one day late with my rent but with them having all that money I don't feel I was late. They charged me $41. There is a couple that lives here in 110 and they were late 4 months on thier rent and nothing was done to them. My friend that no long lives here was late many times by a week but was not charged a late fee. Our lease states no cars allowed on the property without being registered. We have cars here with no tags on them but nothing is done to that tentant in 108. It took me 3 yrs to get a new door on my apartment and only then did I get it because the door knob was falling out and it was hard to close the door. Tom Lambert in 310 requested a new bathroom floor 14 months ago. He had it in 7 days. I requested a new floor 14 months ago even got the manager to come look at my floor. Guess what? I am still waiting. I am told she hasn't gotten the OK yet from her boss. I feel there is some discrimination here. I also feel I should get interest on my money since they keep telling me they don't have it. Please someone help me.

I am not sure about discrimination here, I am sorry you have to wait for repairs. Have they actually said that they agree that you have overpaid the rent? Why can't you negotiate a way (in writing) to have them allow you to withdraw a certain amount out of future rent.

You need to write them a letter each time regarding your repair issues. Or you need to consider moving if you are so miserable there.

Also, you really should not put other peoples names on the internet, Okay? Okay!
