What is the name of your state (only U.S. law)? Illinois

Our tenant just died. He was renting on a month to month lease since we have the house for sale.

What happens now? What are my responsibilites to him and his estate?

When can we rent the home out? Do we pay the deposit to his estate?

If you have the information, contact the family immediately about the disposition of the apartment.

Deposits are generally due and payable to the estate, but I think the specific circumstances will change depending on how the estate is transacted (testate or intestate). His property should also be returned to the estate, but the family should come pick it up.

Death is no excuse for not paying the rent. Locate the executor of the estate and find out when they are giving notice. In the meantime, don't let anyone take anything out of the apartment. You are sitting in a rattle snakes nest. If he had family members, they will surely be fighting over the property left behind. Those that feel they have been cheated will look to you for recovery of whatever the value is of the property they wanted.

Don't depart with the SD until you find out what if the executor will give notice and clean the apartment so that you can rent it.
