tenant -landlord


We live in Ohio. We rented an old farm house for ten years with no contract but made month to month payments. It was in bad shape but we needed a place to live because of a bankruptcy. When anything needed fixed the landlord would balk, sometimes fixing it or sometimes threatening to evict us unless maybe we could fix it. A couple times if we did it he would take it off the rent, alot of other times he wouldn't. We treated the house like it was our own & kept putting money in to it. He told us if we ever moved out he would make it right with us. He even went as far as saying he would probably sell it to us. We finally, after ten years got back on our feet financially, and built a new home in the same neighborhood. He is now suing us for back rent - 1 month, & cleaning & upkeep fees. We left that house in better shape than it was. He evicted us with a notice from a lawyer before our new house was finished( we moved in anyway). We've come to find out the notice was a fake- he made it look like it was from a lawyer, but they don't exist. My question is can we sue him for duress - for the eviction & threatening us to fix any problems - and for unjust enrichment - for us keeping the house in nice condition?

you said it best you had a bankruptcy and this guy let you rent the place.

so he wanted you out, and of course you didnt take the letter to your lawyer to see if it was real....i guess you had a real estate lawyer at the closing right?

so its your own fault, plus you didnt take any pictures before you handed him the keys so how would I know you cleaned it up?

If you didnt give him a 30 day notice you would owe the next months rent., and the cleaning fees and upkeep are they itemized and are they reasonable and are they only for ONE month? since if you were month to month anything after the 30 days is the landlords responsiblity.

And he had 30 day to make a full accounting of any security dpeosit if not he loses it all, so you can sue him for that..
