If the tenant is supposed to mow and keep up the lawn as per the lease... and hasn't and WE have mowed, can we BILL them for the mowing? Thank you...

What exactly are the lease expectations on mowing the grass?

that is to say, are they really violating them?

Secondly, what was the tenants response when you sent them a written notice to correct the lease violation?

Your lease should provide for a warning and then mowing at their expense. If you did not advise them to mow or you would do it at their expense, you probably need to point out the lease provision that they are violating, give them a chance to start mowing and THEN mow and charge them.

**A: yes, but you must first notify them of the default and give a time to cure and what the penalties would be if not cured by a specific date.

Does the letter for the violation have to be hand delivered / witnessed hand delivered by someone, do they have to sign this? Certified will be a waste of money as I am sure they won't claim it...

Can't they just say they never got it if I post it on the door? Or the same with mail...

They can say whatever they want, but you'll have delivery confirmation. Take a picture of the notice posted on the door, with that day's newspaper in the shot (showing the date).

Postscript:

YOU cannot charge a punitive amount for the mowing, or a penalty clause unless that is in the lease.

You can't do it yourself and charge more than the market rate

You shouldn't have someone do it for an astronomical rate unless you want to get dinged.

You can't get a kickback from someone who agrees to bill an astronomical rate.
