unauthorized billing


I signed a lease about six months ago, the lease states that the landlord pays for water and trash. i started receiving biils for these services and refuse to pay them...the landlord said they meant for for me to sign an addendum to my lease for this but forgot. i would like to get out of my lease instead. can i on these grounds, plus others, (no hot water for a month etc..) and by them giving out my personal information to the company billing me and in essence entering me onto a contract w/o my knowledge, have they broken any laws. im in colorado

My response:

Each month brings new damages to you. Therefore, your only alternative is to sue your landlords for breach of contract in Small Claims court, each and every month that they fail to abide by the terms of your contract/lease.

It doesn't matter what they "intended" to do. What matters are the terms and conditions of the currently signed agreement. Until they get tired of being sued each month, you'll just have to keep filing against them.

You also know NOW...that they will NOT renew your lease without YOU paying for the water and trash...

So plan on moving when the lease is up.
