unaware of paying utilities for another apt for over a year...


What is the name of your state? New Jersey. I reant a 3 bedroom apt in a 2family house that the town has zoned 2 family. the landlord has a 3rd apt off the side behind the garage that his mother lives in. she is also part owner.now I live in the 1st floor apt which was the owner's pat for about 17 years. WE are to pay the electric and gas for the 1st floor apt only according to our lease but our energy bill shows a huge amount. we were higly encouraged by the public service representative to get in an electrician to get a diverse of power evalutation because they only show 2 apts in their computers. the Landlord gave a song and dance about doing it that. and in formed us that our lease will not be renewed because " he dosen't want to deal with energy problem". I personally saw the breaker box just yesterday and the one assigned to my apartment is label as the "main" box and has about 20 switches, meanwhile the breaker box for the other 2 apts only have 2 breakers each. I am now convinced that we are definitely supplying his mother's apartment with energy, she has big applainces that we don't have., Washer,dryer,deep freezer, sewing machines, and the such. What right do I have to have him pay me for the past 16 months of his mother's energy that has been on our bill unbeknownst to us? he says he's only willing to give us $ for the month prior to us moving in. I believe he owes al least $100 for every month we have been here on an average. Can you advise?

First try the build. inspector , and get a report .

Get a report from the PS rep. that only shows 2 Apts.

Then take it to Court once your lease is up , or the issue is remedied .

Your local utility can help you figure out what the average electric user is consuming based on household size and the types of appliances in use. Get that info in writting and bring it with you if you decide to take the matter into court. It can help the court make a determination regarding dollar amounts IF they are going to award you anything back.

I would try turning off the breakers on your box one by one then only turn the ones back on that power your apartment. If you really are providing power to someone else I suspect you will find out pretty quickly.
