preparing answer can i use a bankrupyacy defense even if the bankruptcy didnt list the plantiff as a creditor.

Sorry, but you original post indicates that you do have financial woes. Most people do not file bankruptcy unless this is the case. Are you going to pay rent while you are looking to relocate? If not, then you are looking for a legal way to screw the landlord. If you aren't going to pay rent, then move in with family or friends until you find a new place. Which will be difficult with a bankruptcy on your credit report.

If you are in CA, BK is not a defense and landlord should have been listed in your BK if you wanted the "stay" that your BK would have provided.

Unless your defense is credible, make a stipulated judgement with landlord to avoid court - you be out X and agree to pay Y in installments and then sign and record with court. Then he can only go forward with UD IF you don't do as stipulation indicates.
