For the third time in 5 years the people above us, in our rental building allowed their tub to overflow and our ceiling and the mural on our walls has turned to shambles. Our insurance company reported the people have no insurance, and refused to pay. Our company says it is not economical for them to "go after" these "people". We are left having to absorb the deductible, and many of the costs to restore the room that the insurance does not cover.
Can we take these "people" to small claims court? What is the landlords repsonsibility for allowing these people to continue to harm us?
