We have used a lease which appears to be a Carleton Sheets Res. Lease/Rental Agreement. As we look forward to an Eviction and have previously sent two 5 day Pay or Quit notices resulting in partial payments, we expect to get more "run around" and maybe an additional partial payment. This time we would like to give a receipt which states that we accept the expected partial payment "under protest". We understand that doing so will not lessen our ability to file an Unlawful Det. against the tenants.

We are looking for proper wording for the receipt , if there is any, as well as a better lease to use. We have only 3 rental units, currently. Thanks much. -e.

Next time - use an attorney generated lease if you fall under the guidelines for use of a common law lease.

You accept rent WITH RESERVATION in WRITING within 5 days of payment....if your notice said 5 day notice to pay rent in FULL or quit, you could have accepted partial payment and continued with UD having sent a letter that you were accepting payment with reservation within 5 days of receipt.....FILE THE UD and use an attorney!!!
