My former roommate moved out last December and was acting as our landlord, since her name was the only one on the lease. We found out last week that she hadn’t paid rent since May and owes the management company $6800+ (not counting the money she owes the three of us). We had an eviction notice on our door and ended up contacting the management company, who had no idea we were living here. They were super nice though and started a new lease with us, which kicked in today. We’re not being held accountable for her mistake since we all had proof we had paid rent to her.

She still has a crap load of stuff here in the condo and we want to know what our legal rights are with it? We have texted and called her several times in the past week giving her the opportunity to pick up her belongings. She has yet to reply. She’s read our texts though. We know this because we have iPhones and her phone is set to show when she’s read the messages. As of today, she has no relation to this condo. All of the bills are in our names now and the locks were changed as well.

We want her stuff out of here and will be moving it to the garage tomorrow. How long do we have to keep it before we can discard of it?

Additional Information:
She left two couches, a desk, dishes, two end tables and other misc household items.

Here is a link to Oregon's §90.425, Disposition of Personal Property abandoned by tenant:
http://www.oregonlaws.org/ors/90.425

This tells you what you need to do prior to disposing of your former roommate's property, if she chooses not to return to claim it.

No address

Thanks Quincy. That was a lot of gibberish. I have no forwarding address for her or have any idea where she is. She refuses to give us her new address so text/voice is the only way of contacting her. The last known address of hers is this address so am I suppose to send an address to her at this address, knowing she wont get it? That’s what I’m confused about.

Thanks

since the property is from the former lessee and you were actually subtenants of that person, you don't get to do anything with it. The landlord is responsible for the property left by a former lessee. Let him take care of it.

They asked us to take care of it. We gave her 5 days to come and get it or it’ll have a new home, the complex dumpster.

Thanks y’all.
