What a mess.


I live in Louisiana.

You guys were so helpful with my first question (my landlord won't return my security deposit) that I thought I would ask another concerning my new rental home. Obviously I have bad luck with rentals.

I found this house through an ad in the paper and went to see it. At the time I visited there were workers making repairs on the house. The landlord promised that I would have a new stove, washer and dryer, that the head-high weeds in the yard would be cut, that the trash in the yard would be hauled off, etc. before I moved in. Stupidly I did not have these provisions written into the lease.

You can guess the rest. I signed the lease and moved in December 1, 2002. None of the above things were done, and the repairs had not been made. In addition I learned that the landlords were in serious financial difficulties. Their car had been repossessed and the mortgage on the house is in arrears. When I contacted them they said that they just don't have the money to do the repairs now.

I have also discovered that the house is so badly wired that it is a SERIOUS fire hazard. When I called the landlord to ask if he was aware of this he said he was. We had a miserable Christmas because the power switched off which it has done several times.

If I leave this house do I have any recourse in recovering my security deposit? What is the best way to proceed from this point?

Call the housing inspectors. They will issue an order to LL to repair the wiring. When LL does not do so, you can terminate the lease and leave. LL will have to refund your deposit & a prorated portion of your rent. However, chances are that LL has spent your deposit & you'll have to sue to get it back, at which point LL will declare bankruptcy, etc.

Ask LL to provide you with the bank & account number into which he deposited your security deposit, as required by law.

You should go to your local courthouse and see how you can put next months rent in escrow.

Take lots of pictures of the garbage, weeds and exposed wiring.

Can the mortgage company evict me since the LL is behind on his mortgage?
