What are my legal rights


What is the name of your state? California

i just moved in to an appartment with a friend. I have not yet filled out an application to be added to the lease.
my son was outside playing with friends on 10-31-02. One of his friends told the manager that we live in the complex.
Both the manager and the assistant manager came to the appartment and informed my room mate that my son and i must
leave in 48 hours. They also told my room mate that they would be doing an enpection of the appartment in 48 hours to
make sure that my son and i are gone. What are my legal rights??

If your name isnt on the lease and you have never paid rent there to the management you have no rights at all your a guest and the LL can and has every right to prevent people from establishing residency with out being on the lease If push came to shove ill bet the LL will work at proving that your friend has violated her lease with them and try to evict her and even if they dont evict your friend now dont be shocked if they dont renew friends lease . If you want to stay that bad I suggest both of you go to the rental office or meet with the LL tomorow morning and negotiate and see if you can still stay there and be on the lease .

What if the LL has a personal issue


What if the landlord has a personal issue with me? Is there anything that i can do?

YES....find a new landlord who has no personal issues with you.

Sorry but your kid ruined it for you.

Next time make sure you have a signed lease before you move in anywhere. You cannot be just added to a lease, you have to apply like anyone else and be approved.

Unless the lease holder has the right stated in the lease to have a roomate without the landlords approval.

Farmerj is correct. Without a lease, you simply have no 'agreement' in place with the landlord, which means you have no right to tenancy. And by allowing you to stay, the valid tenant has breached his/her lease, making them subject to eviction by the landlord.

It makes no difference whether there is a 'personality issue' or not.
