What are my rights ? Had to evacuate apartment


What is the name of your state?Miami Beach Fl
Can anyone tell me what i can sue for in small claims.After hurricane Wilma passed over us i had to evacuate my apartment.The roof came off,windows blew out & a tree split our bedroom in 2.No alternative accomodation was offered.The city condemned building & gave tennants 2 hrs to pack up & go.Landlord has refused to pay me back security deposit now i find myself with no home & no deposit to find alternate housing.When i returned to collect possesions found Maintenance had forced entry to my apartment & cleared out my possesions so they could repairs.My rent was paid in full for the month of october & i had to leave on Oct 24th can i sue for the week i was unable to stay pro rate ? Can i sue for my possesions that were thrown on the street ?Can i sue for them entering my apartment without consent.This Slumlord needs to pay for his actions !!!!!!!!!! Please any legal advice ??

You wont get your week that you had left on your lease.

You will get your deposit back as it was not your fault apartment was damaged/condemned

Depending on when you went back to get your possesions. Who told you that you had 2 hours to get your things out? Landlord cannot just throw your things on the street they have to store them for 30 days and contact you to tell you where they are, however they can charge you a storage fee for that. I hope you have receips for everything because if not it will be hard to come up with a dollar amount that it was worth.

Another slumlord... Yawn .... Why are landlords called slumlords the second a tenant does not like something?
I told a tenant once the their toilet needed bleaching to remove the dark stains inside, a dirty toilet was not a reason to change the bowl, they muttered slumlord...Go Figure

If the unit was not habitable you are entitled to the days the unit was in such a state that you could not live in it.

The landlord is not a slumlord because a hurricane ripped his building apart.

How ever you can at least sue for the sec dep back plus the rent you paid for the time the unit was not in a habitable state.

Does not mean you will win also does not mean you will lose.
